Terms of Service
Last updated 21 September 2026.
These terms govern use of TagQuiet, a service of Kyvera LLC ("Kyvera," "we," "us"), by the healthcare practice or individual that signs up ("you," the "Customer").
What TagQuiet does
TagQuiet scans a website you designate for third-party trackers, produces a technical inventory of what it finds, and — where you authorize it — removes specific trackers and re-verifies the result on a monthly cadence. TagQuiet is a technical service. It does not provide legal, medical, or regulatory advice, and using it does not by itself satisfy any law or regulation that applies to your practice.
What you're responsible for
- You confirm you have the authority to request scanning and changes to the website and any related accounts you connect (e.g., CMS, tag manager).
- You are responsible for evaluating whether TagQuiet's findings and fixes meet your practice's own legal and regulatory obligations; that determination is yours and your counsel's, not ours.
- You will not submit a website you do not have authorization to scan.
What we're responsible for
- We scan only publicly reachable pages, respect
robots.txt, and never submit live forms with real patient data during testing. - We apply changes only after you approve a specific cleanup plan; we do not make production changes without that approval.
- We store any credentials you provide to us encrypted at rest, used solely to perform the scanning and cleanup you requested.
Fees and cancellation
Current prices, in US dollars:
- Scan of your public site — free
- Full report, delivered immediately — $29
- Audit — $399
- Cleanup — $499
- Audit and cleanup together — $699
- Monthly monitoring — $49 per month
- Monitoring, paid a year ahead — $490 per year
If you bought the $29 report and then buy an audit, or the audit and cleanup together, the $29 is credited against that price.
One-time purchases are billed once, when you buy. Monitoring is billed monthly in advance and you can cancel it at any time; cancellation takes effect at the end of the month you have already paid for, and we do not pro-rate a partial month. Monitoring paid a year ahead covers twelve months for the price of ten and renews yearly; you can cancel it at any time, the cancellation takes effect at the end of the year you have already paid for, and we do not refund a partial year. Billing runs through Stripe — see our privacy policy for how billing data is handled.
Warranties
We provide the service with reasonable care and skill. Beyond that, the service is provided "as is" and "as available," and we disclaim all other warranties, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
In particular, we do not warrant that:
- our scan finds every third-party tracker on your website — trackers can be loaded dynamically, injected by plugins, or served from renamed domains, and our inventory reflects what we could detect at the time of the scan;
- your website will be free of trackers after a cleanup, if you or a third party later adds new ones;
- the service will be uninterrupted or error-free; or
- the service satisfies any legal or regulatory obligation that applies to your practice. What we provide is a technical inventory and a technical change. Whether your practice meets any law or regulation is a determination for your own counsel.
Limitation of liability
To the maximum extent the law allows:
- Neither party is liable to the other for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, or loss of goodwill, even if that party was told such damages were possible.
- Our total liability arising out of or relating to these terms or the service, whatever the theory of liability, is capped at the amount you paid us in the twelve months before the event giving rise to the claim.
- Nothing in this section limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.
Indemnification
You will defend, indemnify, and hold harmless Kyvera LLC and its officers and employees against any third-party claim, and any resulting loss, damage, liability, and reasonable legal fees, arising out of:
- your use of the service in breach of these terms or of applicable law;
- content on your website, or data your website collected, before we began work;
- your instruction to us to make a change to your site, where the claim arises from the change you asked for; or
- your representation that you have the authority to give us access to a site or account that you do not in fact control.
We will defend, indemnify, and hold you harmless against any third-party claim that the service as we provide it infringes that third party's intellectual property rights.
The party seeking indemnity must notify the other promptly, hand over control of the defence, and cooperate reasonably. A settlement that admits fault or imposes an obligation on the indemnifying party needs that party's consent.
Governing law and disputes
These terms are governed by the laws of the State of Washington, without regard to its conflict-of-laws rules. The parties submit to the exclusive jurisdiction of the state and federal courts located in the State of Washington.
Before filing anything, a party with a dispute will give the other written notice describing it, and the parties will try in good faith to resolve it within thirty days.
Either party may bring a claim in small claims court for a claim that qualifies.
Changes to these terms
We will notify active customers by email before a material change to these terms takes effect.
